PostFrog Terms of Service

1. Acceptance of Terms

By accessing or using PostFrog ("the Service"), a social media and blog post digital marketing automation software, you ("the User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

PostFrog provides a platform for Users to schedule, automate, and manage their social media posts and blog content. This includes posting on various social media platforms on the User's behalf, with their explicit approval. The Service may include features that allow Users to link their accounts with third-party services, including but not limited to Facebook.

3. User Accounts

• Users must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement.
• Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
• Users agree to provide accurate, current, and complete information to create an account and to update such information to keep it accurate, current, and complete.

4. User Content

• Users retain ownership of all content they post through PostFrog ("User Content").
• By using PostFrog to post User Content, Users grant PostFrog a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute the User Content solely for the purpose of providing the Service.
• Users are solely responsible for the User Content they post and warrant that it does not violate any third-party rights, applicable laws, or regulations.

5. Facebook Integration

• PostFrog integrates with Facebook's API to facilitate posting content on User's Facebook pages and profiles.
• Users acknowledge and agree to comply with Facebook's Terms of Service and Developer Policies when using the Facebook integration.
• PostFrog requires explicit User approval for each post made on their behalf through Facebook.
• PostFrog will not disclose User data to any third parties without User consent, except as outlined in Section 4 of the Privacy Policy.

6. Approval System

• PostFrog requires explicit User approval for each post made on their behalf.
• Users can review, approve, or reject scheduled posts before they are published, ensuring User control over their content.

7. Prohibited Conduct

Users agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to the Service or other User accounts.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service or may harm PostFrog or Users of the Service.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by PostFrog and are protected by copyright, trademark, and other intellectual property laws. Users do not acquire any ownership rights by using the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. PostFrog makes no guarantees regarding the reliability, availability, or performance of the Service.

10. Limitation of Liability

In no event shall PostFrog, its affiliates, partners, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Service or these Terms, even if PostFrog has been advised of the possibility of such damages. Users agree that the total liability of PostFrog for all claims arising from or related to the Service shall be limited to the amount paid by the User for the Service during the twelve months preceding the claim.

11. Indemnity

Users agree to indemnify, defend, and hold harmless PostFrog, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to their use of the Service, breach of these Terms, or violation of any applicable laws or regulations.

12. Termination

PostFrog reserves the right to suspend or terminate User access to the Service at any time, with or without cause or notice. Users may terminate their account at any time by contacting Customer Support. Upon termination, all provisions of these Terms shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the State of Wyoming.
